just sommet i seen on tv and a question came into my head

if u have sex with a drunk chick who's in a worse state - is it rape or is it indecent assault?

cause in theory she didnt object but wasnt able to consent to it either...

no no calm down i'm not in trouble and nor have i done the above...

My personal opinion is that it's 6 of one and half a dozen of the other if both are drunk but no doubt in the eyes of the law it's rape.

Back to the thread ... yes, if a woman/man is completely comatosed and not in a state to consent or otherwise, I would consider this rape. Have been lots of successful prosecutios on this situation in the past.

Trouble is, lots of women probably don't report, it as would blame themselves for getting in such a vulnerable position anyway, and would be open to criticism... specially from other women, may I add.

Consent is usually the sticky point. What is consent? When you pick a bloke up for a s**g Kate ( theoretical question ;) ) does he always say "do you consent to me having intercourse with you Kate?". Even if he does and you say yes, where is the proof that you said yes if you change your mind later?
I am glad I am married so don't do the picking up women/being picked up thing anymore, it's getting far too dangerous.

No, of course not Neil .. it just sorta' happens doesn't it and you don't say 'Stop'. If you do and they persist, then that's rape. Ok, very, very drunk lady doesn't say 'owt, but blokes do know the difference as not much response physically like .. usually cases are brought as mentioned before when victim is completely out of it.

All very difficult this rape thing though, usually one word against the other.

Thats just as confusing Mick. What is the definition of drunk? How can you decide if someone has drunk too much and is classed as drunk so having sex with her will be classed as rape.

How will Chav ever find a girl who wants him to touch her that is stone cold sober? ;)

Well, a very difficult thing to prove isn't it ? Wouldn't like to be the judge on this one and I do feel sorry for the blokes sometimes. The cases that are successful are usually where someone has helped them home in the guise of friendship and then sexually assaulted them.

As I am off on me trolls now, sorry that I will miss what our other 'esteemed lady members' have to say on the subject when they log on.

Promise I won't pinch any Spanish waiter's bum over my dinner whilst imbibing that bottle of wine at my side ... :D

ok supposing u agree to go to do a guy then get drunk as ur in no state to make decisions - during this drunk time u say no - does that count as a decision?

surely if a yes when ur drunk may not count then a no may not count either?

'No means no' is all very well but I think Mani is referring to a situation where she can't remember having said yes because she was paralytic at the time.

After reading the thread again I wonder if it is just a case of a "notch on the bedpost" for men? Some of the guys at work think its manley to bed as many women as they can and if they are drunk then its easier. It does nothing for the women and says a lot about how shallow men are when a women is seen as a toy to be discared when the fun is no longer there. While men take this attitude then any women they bed could cry rape because it was demeaning and the fact they were drunk does not detracted from the fact they might have said no. The courts dont help matters nor do those that shout falsely but its there and there for all to see. Just because a women is having a drink and a lirt does not mean its a comeon to the guys there that she is "up for it" regardless of what the gent in question might think.

The stud and s*** labels dont help matters either as a women who sleeps around is in some cases assumed to have agreed to sleeping with a guy. If guys cannot control their urges when under the influence when in the company of a women out to enjoy a night then they should not go out. Women are not into wham bam thankyou mam dispite the train of thought of men. A women regardless of the state she is in through booze should be shown the same respect that she would get as sober.
