Man Arrested............Body Found
 

A body has been recovered from the Leeds Liverpool canal near to Barden Lane in Burnley. Police are not releasing any information about the body.

Coincidentally a man from the Hapton area has been arrested and is being questioned re the missing Accrington man David Guilfoyle. Could it be connected, are they getting nearer to the truth, lets hope so........

sounds almost too much of a coincidence to me. If it is david then it will give some closure to the family my thoughts are with them it must be a horrendous time for them

If it is the missing person he can't be in too pleasant a condition. This is one of those times when the Police actually justify the money spent on them.

Just been on the BBC website and they report that a man has been charged with murder, they name the man also, sorry there's no link not sure how to do that.

Thanks for the link Bazf. Can they verify whether the body is that of Dave Guilfoyle? I didn't think that you could charge for murder in the abscense of a body. Then again they never found the body of the lady on Burnley Rd either.......

Their has been no connection mentioned yet between the discovery of the body in the canal and the charging of the man from Hapton.

Thats true Fireman but the charging is in connection with Dave Guilfoyle and can they charge murder without a body? Not sure.

They must be able to charge without a body if they have enough evidence pointing to murder, as in the Burnley Rd case, but I should think that they would be on pretty shaky ground. They would have to be able to prove beyond a shadow of a doubt that it was murder...

In the Burnley Road case they found traces of her blood in the kebab shop didn't they? It will be good for the family of Dave esp Sammy if there's closure, even if the news isn't what you really want to hear.

If there is enough evidence to make a case that someone was murdered then a person can be charged with the act of murder, even if there is no body to be found.

They obtained a conviction with the burnley road case with no body. They must know what they are doing.

Habeus Corpus is a Latin term which means "you should have the body," and is a legal principle which requires that the government must present an accused and arrested person before an impartial judge in order to prove that there exists just cause to hold that person against his or her will.
Without the Writ of Habeus Corpus (traditionally called the "Great Writ"), a government could hold a person in jail for any length of time without having to prove that there is any good reason for doing so. Thus, if you are being held by the government, you can request a writ of habeus corpus and, if a court issues it, then the government must bring you to that court and demonstrate that they have arrested you for a compelling reason. If they cannot, then they must set you free.

The principle of habeus corpus also refers to the power of federal courts to review the legal decisions made by lower state courts. Thus, if you think that you have been unjustly convicted in a state court, then you can appeal to a federal court. If your appeal is approved, the federal court can issue a writ, requiring that government officials bring you before it so that your case can be reviewed. This oversight authority has been restricted in recent years, in particular with regards to death penalty convictions. The ability to request a hearing before a federal court means that it takes longer for a death sentence to be carried out, and about 40% of capital convictions are overturned on federal review. Supporters of the death penalty find this unacceptable and have successfully lobbied for less federal oversight.

It should be noted that a person's right to a writ of habeus corpus was the only one considered important enough to be included in the original text of the Constitution.

Shane Fitzpatrick and has been charged with murder and is currently in prison on remand. He may apply for bail. I don't think the body is connected.
