www.kipax.com

Arrrgh! :(

Having spoken to the people at the football league.... The upshot is... No more ASFC match collection on the KIPAX website. (Existing ones will stay). I will be unable to publish ANY stanley pics on there. I have even had to remove the statement that I am official club photographer from the website as it makes it look like an official website :(

I will be continuing as club photographer (Ya would have to shoot me to stop me) but my pictures will only be seen in the club program and restricted shots on the website in a reportage capacity (Still unsure what website will be used) and "maybe" in the club shop and online shop.

KIPAX .com will continue as I still have my conference licence and will do non league games as I have in previous seasons.. But no more stanley games on there... Believe me not a decision I am happy about as you can imagine and one the club have no control over.. this is big boys rules now.... sigh.

Bloody shame that Kipax, one of the first of a few big changes I suppose the club will have to make now we've made it into the league.

Very disappointed to hear that, Mr K. Does this mean we'll have to have one of those Premium TV websites, as well?

Just out of interest, what is the legal basis from which the league have arrived at their policy? Surely any image you make is your copywrite?

Doug 03-07-2006 16:16

Re: www.kipax.com

Absolute ****e, who are these mandarins to change a way of life. I feel gutted at that decision Mr K the football league should be brought to book on this issue, are these rules set in stone or is it possible to change the situation. What about an appeal. Is that a viable option? Is it possible for the supporters to get behind you and force a rethink?

I know how dependent I was in recent years on following Stanley’s progress via your Photographs. Irrespective of individual opinions on the game, the club or you yourself this decision will have a world wide impact on supporters who depend of the photos as well as those who for whatever reason have been unable to attend games locally.

I have little doubt that some provision will be made of fans at a price. End of an era Mr K. How about getting Mrs Knight to rise some funding for you to put together a Photo Newsletter….

Re: www.kipax.com

Sorry to hear about this and I reckon the decision stinks!!!!!!

I have enjoyed coming back from matches and waiting for the pics to be uploaded to re-live the match good or bad!! Shall be sadly missed :(

maccawozzagod 03-07-2006 17:49

Re: www.kipax.com

can you still publish the fan pictures bearing in mind they will not feature ASFC or any sponsor boards or owt.

The pictures you put on your site are an invaluable picture story of the events of the match. It is always good to see who went, and what flags were on display and how fit or ugly the opposing fans are.

Very dissapointed to read this news KIPAX.I too was looking forward to viewing your snaps after each game. Are you still able to do cup matches? And will you continue to post pictures of developments around the ground etc,?

That's really sad news.

I will miss your brilliant pictures very much. Looking through them after a game is a real treat, especially the away games I can't get to. You capture not only all the football action but the whole spirit at each match.

Hoping beyond hope that somehow you will still be able to carry on as you did previously.

This is a black day for all Stanley fans around the world - very bad news indeed Tony - sorry to hear it.

Re: www.kipax.com

Is it a final decision and nothing can be done?

If we started a petition would it help?

It seems a great shame after all the publicity we got last season that a well used and much loved part of Stanley will be no more.

Really sad. Just discussing it with 'im indoors and we both agree it's unfair. All that support and effort you have put into it and what do you get?

Sorry mate x

Its A Shame And Like All Stanly Fans Far And Wide In This Big World I Would Allways Look At Your Pics, Just One Thought If You Stood In The Crowd At The Front (im Sure The Accy Fans Would Move Out Of Your Way) How Can They Stop You From Taking Pictures And Why Cant You Post Them On A Web Site?

Re: www.kipax.com

God Tony thats cr@p!! The pictures are a way for the fans who can't get to the games to see the events unfold and not just pitch side.

I just assumed seeing as you were an official conference photographer that they'd just upgrade you to league level.

Does this not infringe your human rights?!!!

Diesel 04-07-2006 18:25

Re: www.kipax.com

This seems like a load of bo**ocks to me, how can the football league decide what you do with your camera? If you can't appeal, start a petition, I would be amongst the first to sign it. The Football League already look like a joke as big as the Conference, the powers that be are all incompetent! It's all about sponsors and money these days, they don't even care about the fans. Seriously Tony, appeal if you can, if not we need to start a petition, 'cos the desicion is unfounded and unjust.

KIPAX 04-07-2006 20:35

Re: www.kipax.com

I am still taking pictures.. Its what I can/cant do with them thats the problem guys.. I cant publish them on kipax.com ... They wont be my pictures they will be the clubs pictures which is different to before... I wont have a licence .. the club will..

I cant get a licence myself because silly little me doesnt sell pictures... You have to prove 15 sales over the last year and I cant... thats sales to media.. papers books etc.

It is illegal to take pictures in the ground from anywhere other than touchline.. even licenced photographers arnt allowed... however this obviously does happen all the time.. but stewards can remove you from the ground for it and they should know that rules themselves?... Your certainly not allowed to publish them if you manage to take them.. although again it happens..

I cant go against the rules or I will lose what licence I have..

Crowd shots.. when I asked him about that he seemed shocked and said that was a big no .... sigh :(

I will know more when I see the agreement I ahve to sign.. But deffo cant publish as I was doing before :(

Gayle 04-07-2006 20:45

Re: www.kipax.com

Are they paying you though?

Because if they are then they are entitled to state the terms and conditions.

KIPAX 04-07-2006 20:52

Re: www.kipax.com

Pay me ? hehe NO .. the club dont and never have paid me and the league dont pay you... There are a few people who seem to think I have made money from the club but in fact its been quite the opposite..

They run the league so they can say what happens in the league.. Its the same for all photographers of every club on all the leagues... The conference is a little more lapse..

All football grounds in the UK have ground rules and one of which is NO photography on the ground other than by licenced photographers and only at touchline.. No photography from stands or terraces by anyone.. thats in every ground rules in the country..

Everything at a football club is licenced.. you cant take pictures of players and do what you want with them ... if you ahve your own licence you get to do more.. But as I say... because I havent been selling my pics I am not deemed a proffesional.. I would need to prove media sales and believe it or not (Karen Faz will back me up on this) they want to see press cuttings and matching invoices.

There league.. there rules :(

Gayle 04-07-2006 21:07

Re: www.kipax.com

I'm a bit confused though. If the club are using your pictures shouldn't you be charging them for them? Is there going to be a licensed photographer on the ground or are they going to miss out?

If fifteen of us on here buy one of your prints would that make you a professional? Can you not use other things that you're going to get paid for to state that you're professional?

Have you not got examples of the local papers using your pictures?

Sorry, I know I'm being a pain but there must be some way round this.

the licence is given to the club and they sort of sub licence me to take the pics... thats how they automatically become ther e pictures and not mine

Has to be sold to recognised MEDIA and backed upw ith clippings and invoices for each one.... thats what me and seperatly the club have been told... mad innit..

Instead of paying me.. the local papers put www.kipax.com on all the pics... i recently got paid for some pics from them at the end of the season but it wasnt 15 and they didnt itemise them.. even if they did it wouldnt have helped as not enough.

what they do.. they do to every club in the league and always have...

a loophole might be the online shop and selling pics on there.. you ahve to show them to sell them so in effect it would double up as a shop and gallery... but gotta wait to see what website they use yet...

ossyclogger 04-07-2006 22:15

I probably won't get to many away games, but as for home games,as they say I will publish and be damned.

Doug 04-07-2006 22:50

Re: www.kipax.com

Mr K. Can you still sell Photographs from previous seasons? If you can would they count towards the 15 you need to go pro.

KIPAX 04-07-2006 22:57

Re: www.kipax.com

Doug they can be any from anytime... any pictures so long as action shots... from any team... But like I say.. they must be to recognised media....

Even then.. it means I get a licence but would still be restricted in what I can do with them as terms of the licence.. I dont know what that is yet.. But MikeA pointed me in a direction and I am looking into that.....

A good loophole like I say would be the shop

Doug 04-07-2006 23:03

I'll certainly miss the pics.
Do you want to sell 15 to kshexpress or to the kshmirror
Seriously though, can you not publish them on the fishy site? with permission from the club of course, if there tecnically their photo's now surely they could be put on there.

for arguments sake would a website be a recognised media? Would it not be fair to say that as a professional you earn your corn by selling advertising space on your website based on the pics that you have? Or on the Ultras site?

Alvin the chipmunk 09-07-2006 10:15

Re: www.kipax.com

Does this involve all games, eg FA Cup and League Cup?

Does it also cover reserve games?

Bagpuss 09-07-2006 11:43

Re: www.kipax.com

Not the same is it, just 4 pictures on the fishy site and no crowd shots to find yourself, Kipax there must be a way round this.

Ashley's Dad 09-07-2006 16:49

Re: www.kipax.com

My lad's on trial from Chesterfield, who's official photographer takes loads of pictures, published on her site & the club's. She's clearly a professional, as sell lots of fancy images as well (tinajenner.co.uk); it's a good service, and a very lucrative one for her, I would think. Couldn't you be subcontracted by a local 'professional' firm, who would be recognised by the League, but might be happy to take a slice of the profits from sales, and lap up the publicity?

Great picture of my lad nearly having his ankle broken by the Burnley guy, by the way!!

KIPAX 09-07-2006 21:17

Re: www.kipax.com

I will be going back to a full array of pictures from now on.. But as part of the fishy site and not kipax.com so normal service will be resumed... but the address changed....

For everyone else thats all great.. back to normal... for me its bad...means next to no traffic to my website for the other pics.... hmmm...

Ashleys dad.... i think ya missed the bit about the licence.... she will have a licence.. i can only use the clubs licence... which limits me somewhat :(

Gayle 09-07-2006 21:23

Re: www.kipax.com

Just another thought - if the club have the licence but they sell some of your pics (which they'll be able to do) will they count towards your 15 that you'll need to get your own licence?

KIPAX 09-07-2006 21:30

Re: www.kipax.com

No cus they will be selling them not me :(

It has to be the media.. newspapers or magazines and you ahve to prove it with invoices and the actual paper cutting.. as said earlier in thread... ya cant do a paper cutting from a website... I know it sounds daft but thats what they said.. the man from the league... Karen Faz knows all this as well.. its 100% true..

Gayle.. who do you see about stalls on the mela.. I know last time lots of differnt stalls.. I could set one up with mounted and framed pics.... wont count to press pass but will count to this lens :) not just stanley pics... local area as well.. plausable ?

Gayle 09-07-2006 21:33

Right... had my first look at the league 2 photographers licence..

1) I deffo cant carry on with kipax.com

2) There is NO limit to the amount of pictures that can be put on the official website after the game.

Thus same service ...different website... :) starting wiht the very next game i go to..

Good news for the people looking... bad news for me... as the only thing I got out of doing it was the kudos of a succesfull website and the 5 mins of fame.. now I get nowt :(

So a new website will be made for kipax and hopefully a slighlty different direction albiet still photography.. but to the next level :)

entwisi 11-07-2006 14:11

Re: www.kipax.com

Would it not be possible to make the pictures on the fishy site links via your site to larger pictures back on fishy, something along the lines of

I see a picture and want to see a larger image I click the thumb and am redirected to your site, on first visit I am asked if I would like to see other work of this magnificent photographer, a cookie records my response, if I say no then in future I am directed straight back to fishy, if I say yes then I can browse your site with a link back to fishy when I've finished. Or even, is there anything that fishy could/would do that would pop a nice dialog offering to open your site in a pop-under, again, cookie to record my ongoing preference

Just a couple of thoughts really.

KIPAX 11-07-2006 15:25

Re: www.kipax.com

They would have to exist on my site in order to link to them... thus anyone could go straight to my site and there not supposed to be there .. Just had a meeting at the club.. Eric and Rob ... All is well.. Normal service resumed aftre next game but from accringtonstanley.co.uk and my site goes a bit different :)

entwisi 11-07-2006 19:02

Re: www.kipax.com

they wouldn't have to exist on your site at all, purely a circular link out and back,

It was just a thought, if you are happy with your new plan then fine, just trying to add options

KIPAX 11-07-2006 19:09

Re: www.kipax.com

Not too happy with it at all to be honest.. but end of day I cant have owt on my site or be seen to be making it look like my site is official.. hence the change... but certainly not happy.. Now making mine different.. would be happy if it was staying the same as is now and anyhting else is a poor substitute...

dunno what made you think I was happy wiht situation... but I am resigned to it :)

K.S.H 11-07-2006 19:13

Re: www.kipax.com

We could be missing the obvious here, what if you had a big banner at the top of the site saying it was an unofficial site and images are being displayed with the permission of/on behalf of the club, tick a box etc to confirm you understand this before entering it

KIPAX 11-07-2006 19:20

Re: www.kipax.com

Dont forget theres two teams in the pictures... the other clubs in the league (all of them would be featued) wouldnt be best pleased... hence why its a no-no

It defeats the whole object of having the licence and as ya can imagine the league wouldnt go for that..

the last thing we want to do is try and be clever and find a magical loophole just for the league to pull the licence and have no way of taking any pics :(

appreciate the thoughts people :)

K.S.H 11-07-2006 19:24

The whole decision stinks Tony - and I am really sorry about what has happened as I think your photos are superb ! You really do capture all the action and whole spirit of the game and it just won't be the same.

I have to admit that I was unaware of this the other evening when we chatted at Alsager, otherwise I would have mentioned it then.

So much for progress.........but at least we have the memory of all your terrific photos of past games and events.:D
