Before any litigation takes place the powers that be should establish if the soldiers were in fact following orders and whose orders they were.
Soldiers in the field are given some licence on how to react to or handle a particular situation and they could act not strictly in accordance with the given orders. In such a situation they are responsible for their actions. Otherwise the blame goes up the command line. However each level of command also has discretion on how to apply any given orders and the higher you go the closer the ranks are closed.
