I didnt state your kids go on to his drive, but if thats all he is filming/ allowed to film then there shouldnt be a problem.
I know the council (as example) has some sofisticated cameras that can be aquired to help film anti social neighbours, and can be used in court as evidence.
Can you not just ask the neighbour what his intentions are with the camera and voice your concerns.
