Is it the responsibility of HBC? These are the things I'm never sure of. My mother won a claim from the old Accy council many moons ago for a defective paving slab in Church Street. It gave way at one end as she stepped on it and she twisted her ankle, fell over and broke something. Can't remember what but she was compensated.
