RECENT APPEAL DECISION
Purpose of Report
The attached report advises members of recent appeal decision.
RECOMMENDATION
(i) Members note the report.
(ii) That authority is given to the Chief Planning and Transportation
Officer to instruct the Council’s legal department to arrange a
prosecution hearing in the local magistrate’s court for non compliance
with the enforcement notice.
Planning Application No. 11/09/0279
Erection of ground control room at first floor level, with access stairway and
screen fencing
Crown Ground, Livingstone Road, Accrington, BB5 5BX
This appeal was dealt with by written representations and was dismissed on
5th January 2010. A copy of the Inspector’s report is attached.
An enforcement notice has already been served in respect of the
unauthorised development. The owner did not appeal the enforcement
notice. The Council took the decision that it would not arrange a prosecution
hearing whilst a planning application appeal decision was pending. It is likely
that the magistrates would have put proceedings on hold in such
circumstances. Given that the Inspector, acting on behalf of the Secretary of
State, has now dismissed the appeal I have no other option but to recommend
that legal action be pursued in the form of a prosecution hearing in the local
magistrate’s court.
