You are right, Mancie. If someone finds a burglar in their house, then of course they should be able to deal with it in whatever way is deemed necessary (including assault and even killing) if that is shown to be a reasonable response to the situation.
But what about the situation where the burglar holds up his hands and makes it clear he will leave the house peacefully without further ado. Are we saying the householder has carte blanche to treat the burglar as he likes, including killing him in cold blood, because he knows the law will exonerate him?
I don't think so!
