ASBO's

Does anybody know much about the law regarding these?

Just received a letter this week from my local council regarding my car!

Looks like somebody has complained about the sound it makes.... firstly im not sure how anybody can fail to love the sound of a V6 capri,
but secondly they seem to think i go outside in the wee small hours of the morning and rev my engine? The letter actually says i do this repeatedly.

I find this all rather odd considering i've only ever used the car once after midnight, and i certainly don't sit outside revving my engine like some 17 year old spotty chav in a nova. (No offense to Nova owners)

I'm quite deeply offended.

I have spoken to the woman from the council who's name is at the bottom of the letter and had her explain to me what the problem was, she told me that she had received a complaint or complaints that i have been going out late at night/early morning and when i start my car i rev the engine quite a lot before i set off and that i have been doing this repeatedly, this is pretty much what the letter had already said.

I then asked her, seeing the letter was dated the 8th of January, how many times could i have done this when i had actually only bought my car on the 31st of December giving me a grand total of 7 nights of owning my car before she posted the letter. She seemed quite shocked that i had only had the car for such a short period of time, i'm assuming that she had been told this is a persistent problem.

I then asked her that seeing on a monday and a wednesday i go to uni and set off at 7am and dont get back till 10pm am i going to get an ASBO for this? Her reply was that they will have to review the situation in a week but the complaint wasnt about me returning with my car late at night but only setting off.

'but my car makes exactly the same noise regardless of driving away or coming back?'
'What do you mean? are you trying to tell me your car makes the same noise when you turn it off as it does when you start it?'
'erm what im saying is, that while the car is running, it makes exactly the same sound'

This she didn't have a reply to, she simply stated that it was the revving of the engine that was the problem.

'So your suggesting that i go out in the middle of the night, start my car from cold and rev its engine? a 21 year old classic car in near perfect condition?'
'Oh its a classic car?'
'What did you think it was?'
'I dont know, i just assumed it was a saxo or something'

Basically I now live in fear of starting my car once the sun goes down.

I have no real idea of who it is that's made the complaint but it could be one of 2 or 3 people on my street.

When I was renovating my house, which is ex council, I got a letter telling me to clean the garden because of complaints it was a mess, so I had a look round the streets, there were gardens far worse than ours (who were not renovating), and I told them so, they never bothered me again. If I were you, I would be reminding them about the taxi drivers constantly pipping thier horns at all hours, and the jobless having noisy garden parties until all hours, keeping the working (trying to sleep) people awake at night, they don't do much about that do they?

Looks as though you have upset one of your neighbours at some time or other, or they are jealous of your car.

The local council you mention.........is it HBC ?

Tell us what street you live on and I am sure we can arrange for 20 cars to sit on your street at midnight revving their engines. Neighbours are the worst invention ever. :D

No actually its Rossendale council, i live up in rising bridge so even when i have a Hyndburn post code i actually live in Rossendale.

I really don't know how i could have upset anybody, i don't speak to most of them. They are however mostly *******, so that could explain it.

It could be you leaving for university at 7 a.m. that is the problem.

The complainent might not roll out of bed until 9.25 a.m., to watch Jeremy Kyle and then Trisha.:D

Perhaps it's your council's standard procedure to write to everyone, when they receive a complaint. You've apparently done nothing wrong, I'd just ignore it.

What I always find strange about these things is that if you ask who complained you get told "oh it was in confidence so I cant tell you". Right...So someone has accused me of something, and I cant know the name of my accuser ? I know its to protect people, but I`m sure some people do it maliciously just to put people through the stress of it all.

Im deeply offended, how dare that council woman diss saxos (i have urges for a saxo). Something similar to this happened to me, only difference was that my car (rip xr3i) was revved quite a lot, But i was at college at the time doing motor vehicle so i used the escort for alsorts of tests and experiments so sometimes it was needed. Unlucky really mate, id love to hear a capri every morning, ill try and get the daft moo next door to move and then you can move in with your capri.
