interesting article in the Daily Telegraph
Rise of 'Vulture Syndrome' blamed for increase in disputes between family members over wills - Telegraph

seems there has been a big increase in law-suits/litigation over the estates of the dearly departed family members .

So the question is ....have you sorted out who gets what , or are you of the opinion , "let them sort/fight it out between themselves " or maybe "I've got nowt to leave anyway " .

Guess most folks have got a will written out somewhere , divi-ing it up any money equally amongst your off-spring after the funeral and any debts have been paid off .

Just wondering how you sort out "family momentoes" stuff that won't/shouldn't be binned ..ie ...Grandads and Great Grandads war medals ...do they go to the eldest , regardless of sex or the first born son , or even first born Grandson . (must add , not requesting advice) or stuff like Grandmas hand embroidered tablecloths ( do younger folks know what a table cloth is ? ) or family photos .........should this stuff be sorted out early , and how early ?

Or have your kids allready snapped all the good stuff allready before the others lay claim

Okay , just wondering how other "older" Accy web users are/have dealt with this sort of situation ;) ;)

I study trusts law this year and even when the will is made seemingly clear there are disputes over property.

I can't believe you just said 'do younger folds know what a tablecloth is' as well.

It definitely should be sorted out early and it should be as precise as possible.

Sorry blazey , its a generational thing , doubt many of the younger folks still use the "living room" table as an ironing board and the table cloths were used to cover up any scorch marks on the wooden surface , (the days before Formica) :D :D

What is Formica?

I still use the term 'living room'. And I use my floor and a towel to iron on because one of my flat mates keeps locking the ironing board in their room. Haven't scorched the carpet thankfully.

Formica blazey, its what used to surface kitchen units and in a lot of cases still does, but there are quite a few new surfaces used today

I have made a fresh will several times.
At one time my solicitor was offering me wills free, because he was coining it in from all the house conveyancing he was doing for me.
That's what happens when you get shut of husbands.:rolleyes:

making a will is very important.. my brothers partner died and he was left with two young children .... he had to go to probate to get his own kids.....

i made one years ago, but is out of date now n useless, i aint gonna bother again, kids are grown up, i'm the eldest, so if there is owt n any want to argue, let em. as some people are that sad n do behave like vultures, as i have witnessed in other cases, why should i concern meself wi people like that.

As i've been told i should make a will .. as being on my own .. no kids its just my sisters and brothers and cousins and nephews and nieces and great nephews and great nieces. If i dont make a will then anything left afterwards will end up in the government pockets .. not to my family. Thats what ive been told ....... dont know if its right or not.

My hubby and I are only 31 but we've made wills.

We've had them since we were in our 20s.

I think you must when you've got children. It's not just about who you will leave your possessions to, it's about who the children will live with, what happens to your house etc.

Ours covers all eventualities.........him going before me, me going before him or us both going together.

thats a good point, i should make one to say where the kids will live but i cant actually think of anyone i would like them to live with with :confused:

I must update my Will. Everything is straight forward, split between my 3 children, but it appoints my elder daughter as the younger one's guardian if I die. I don't think either of them would appreciate it now they're aged 45 and 33. :D

You know summat?, me and my fella were talking about this the other day while we were traveling to Ikea in the car....I asked ..if we were to be both killed instantly now while in the car on the road, miles from home....Who would pick the kids up from school???, how would anyone know about the kids??:eek:
Who would they live with?...the thought made me cringe.....You dont think ya gonna die, but the fact is ya can snuff it at anytime...and thats is scary, especially when you think what will happen to the kids!:(

One positive thing about death is that, for a couple of hours at least, people will say nice things about you:D ... and then they find out that you have spent your cash, given your home to be used as a drug rehab centre, and all your remaining assests sold, and the coin given to the local humane society. And you can lie happily in your grave going :tongueout

What a blast :rofl38: ... only sad thing is, I won't be around to enjoy it:mad:

i was paying into that for a few years, i wonder how much there actually is.... its a lancashire county council/education authority pension so its transferrable when i start working again

Making a will is one of the first things me and 'erindoors will be doing once we're wed. With seven kids we'd certainly need to know they can go somewhere!!

currently going through a shambolic mess due to my mum dying last january and her not leaving a will, but she did leave a couple of policies worth £***** and nothing put in writing where they should have went to..so under the law they automatically get shared between myself and both sisters (her kids), the result of that is other family members totally disowning us and making sure we have been written out of a certain will which is their choice, things have been said to us all which have burnt more than a few bridges and it will be more their loss than ours.
the thing I have learned through this is to have a will in place (now sorted) and some people are only friendly when they think money is up for grabs.

If you die without a will then it would be shared amongst your nearest blood relatives first..if no living full blood relatives, then neices, nephews etc... if no relatives at all can be found then it goes to the state.

However I really think it is important to make a will so the money goes where you want it to go and not someone else deciding for you..

another thing to think about if you want it shared amongst a few people is to have it written in percentages and not amounts...savings, property values and some policies can go up and down ...

eg is.. my Great Aunty died last year, she had no children and had specified varying amounts to many family members/friends and the remaining amount (at the time the largest amount due to it including her home) to be shared equally between her two favourite neices... however, although the will was only a few years old her savings had reduced and her home had dropped drastically in value.. the two neices tried to make sure everyone got what they were left from her estate which at the time of writing the will would have come from savings/policies alone..but at the time of her death it wasn't enough and because her home had dropped in value so much they nearly ended up getting alot less than others named in the will which is never what my Aunty had wanted!!

So think very carefully how you write your will and try to make people very aware of what your wishes are :)

You should NEVER do a will yourself. Get someone with a lot of experience and knowledge to write it for you, with you present, and consider whilst it is being wrote how someone could misinterpret it to take advantage.

It's not nice to think how people might take advantage but it definitely does happen.

I was talking to one woman who told me that her parents had left all their money to the dogs home.
She was most upset when I suggested that she would at least get a share.

As I will either be fertiliser or cement powder I dont have a clue what will happen to my worldly stuff. To stop arguing maybe I should blow it all up if I get enough warning of my iminate demise. :p

seen as i have nothing much i guess teh only thing i can offer is that when my body is cremated it will provide some heat for young couples making out behind teh cremitorium

like other souls have done for me when i was younger

Am awaiting paperwork at the mo, just type in Institute for plastination and it's all there!
It will be written into will as well.
Daughter isn't massively convinced but she enjoyed the exhibition in Manchester and to be honest, once the coffin is in the ground or cremated , what does it matter?

That’s another reason why we should dump the monarchy and the lesser royals.

However what you failed to mention is that the crown is right at the bottom of the list of possible beneficiaries.

With spin like that you should be in government.
