Court Hearing 4th November - The Verdict
There are now only two working days for the full HMRC debt to be discharged. In the absence of any statement that is fully verifiable, to the effect that payment has been made between now and close of banking business on tuesday evening, then I will be at the High Court on wednesday morning. Once a decision is reached I intend to get the verdict posted on here ASAP - so it will be a case of watch this space.
Make no mistake - there will be no second, third or fourth chance on wednesday morning. Registrar Symmonds is not going to be messed about any more, so even a minor shortfall in funds received will result in the petition being accepted and the winding-up process begins. I dread to think that the future of ASFC may boil down to banking charges incurred which have not been accounted for in the payment transaction. The verdict we are looking for is the petition thrown out because the debt is settled. So I suggest you stand by your computers & your phones and get ready to pass on the good news from 10.30 onwards, wednesday morning. |

Ilyas here. i thought i better post before this thread gets ahead of itself. I was on the road all day today (horrible on the m6 by the way), and just saw email. I sometimes wonder if being so accessible on this forum is a good or a bad thing, but since i have started in this way, i better keep going.
firstly the full amount HAS NOT BEEN paid off. As you know, Peter and I have guaranteed the shortfall, and the situation is therefore as follows: 1. £96,000 has been sent to hmrc 2. I believe that another £100,000 (PFA) will be sent on MOnday I will speak with the HMRC on monday, and look to make a significant payment on Monday itself, once they have confirmed their receipt and then see how much, if any, we are still short. I am taking a belt and braces approach, and will still call them on Tuesday to see if there has been any slippage between "lip and cup". In providing you with this update, please all you should note that I am dependant upon information from the club, but I do think this is accurate. You should also know that I am NOT the club, and therefore its possible that they dont condone this information being shared. Given the high levels of anxiety of the past week, I think it worth sharing with you. I would urge you all to be relaxed about this coming week. I know that is tough, given our previous track record as a club, but as i say, Rob Heys has been totally co-operative, and the information i have posted above is accurate in my opinion. Ilyas |

Thanks Ilyas for updating the thread with best of what u know or can presume at this stage. I trust u so shall not worry too much at this stage but do worry for thereafter with the present control.

So there is still time for the Boards original plan to come together; if the mortgages come through they might need Mr. Khan’s and Mr. Marsden’s assistance.
