How does anyone know at what point someone is too drunk to consent? Perhaps as well as conventional protection, people are going to have to start taking breathalisers out now whenever you think you might meet someone you end up staying the night with...if you cant drive you cant......:eek:

She certainly had a very clear memory of the Law upon waking though! Surely theres a big difference between Rape and a Mistake.

In the report it more or less says she had 3 bottles of wine, on this I have some observations 1/ I'm glad I'm not a friend, 3 bloody bottles :eek: 2/ it appears she must drink this much regularly, you don't drink so much unless your used to it. 3/ to accuse the guy of rape must tell this woman something, stop drinking an make sure your in control if you engage with the opposite sex 4/ like entwisi said if he is convicted blokes may as well give up. Rape is a terrible crime, but for a woman to cry rape in this instance is bordering on the ridicules

How drunk was he? If he was sober then its rape... if he was as drunk as her then surely the same rules apply for both and he wasnt in a fit condition to say no either... he should have counter claimed that she raped him....

You dont have to drink the same amounts to be equally drunk.. we all know that yes?

Also, they say not in a condition to say 'yes', but if you are sober don't often actually say 'yes' do you ... just sort of happens, unless you say 'no' ...:confused: If you don't say 'no' usually a sign for a fella' to carry on. Love Taggy's remark about the breathalyser.

This is going nowhere, the CPS feel obliged to run these "Non Starter" cases following pressure from various groups. The Government keep fiddling with the wording of the Act but a jury of 12 men AND women are just not convinced "beyond reasonable doubt". We are not talking about stranger rape here we are talking about adults who know each other and often work together.
Still the lawyers will be rubbing their hands.
